Terms of Service & Charter Partner Agreement Terms

1. Territory Exclusivity (1 Contractor Per Trade Per Town)

While a Partner's account is active (including during the initial 3 Free Exclusive Leads Trial), One Towne Media LLC grants the Partner exclusive routing rights for their designated trade category and town/ZIP territory (1 contractor per trade per town). We do not sell, share, or syndicate leads from that trade portal to any competing contractor in that territory.

2. Transparent Pricing & 2-Part Zero-Risk Performance Guarantee

• Trial Wedge ($0 Upfront): Qualifying new trade partners receive their first three (3) verified exclusive homeowner leads at $0.00 cost with no long-term commitment.
• Track A — Exclusive Town Leads ($39/Verified Lead or $149/mo Whole-Town Flat): Every lead passes our 7-Layer Edge Filter (valid 10-digit US NANP phone, in-territory ZIP code, anti-bot honeypot/timing check, and 24-hour deduplication). If a disconnected phone number, bot, or out-of-territory inquiry ever slips through, Partner may reply REPLACE via SMS or email within 72 hours for an immediate $0 replacement credit. On the $149/mo Whole-Town Flat plan, if fewer than four (4) verified exclusive inquiries are delivered in a calendar month, the following month's flat fee is waived at $0 until the 4-lead floor is satisfied.
• Track B — Managed Online Storefront ($79/mo Core Back-Office to $129/mo Complete 17-Pillar Suite; $229/mo All-In Bundle): $0 upfront build fee. Monthly billing begins only after your custom storefront, branded email routing, and selected modules are live and verified.

3. No Ranking Guarantees & Transparent Reporting

Google search rankings, Google Map Pack positions, and AI search citations depend on third-party algorithms outside any agency's control. One Towne Media LLC does not guarantee specific placement positions (such as "Top-3 Map Pack" guarantees); instead, we implement technical local SEO best practices (structured JSON-LD schema, service-area geo-pages, Google Business Profile optimization, and automated review velocity) and provide transparent monthly Google Search Console, GA4, and call/lead logs.

4. Month-to-Month Cancellation & Client Asset Ownership Upon Exit

There are no long-term lock-in contracts or early termination penalties. Either party may pause, downgrade, or cancel any monthly plan at any time by sending a written notice via text message to (631) 526-2801 or email to [email protected] prior to the next monthly billing cycle. Upon cancellation, the Partner retains 100% ownership of their custom business domain name, complete customer/job CRM CSV export, signed PDF work orders, and third-party review profiles (Google, Trustpilot, Yelp, Facebook, BBB).

5. ESIGN / UETA Electronic Signature Terms

Documents, estimates, work orders, and partner agreements executed through /docs/, /pay/, or /onboarding/ comply with the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA). By drawing or typing your signature and checking the consent box, you agree that your electronic signature is the legal equivalent of your manual handwritten signature.

6. TCPA / SMS & Automated Communications Terms

By submitting your telephone number on any form on onetownemedia.com or a partner storefront, you provide express written consent to receive transactional calls and SMS/MMS text messages (including instant lead alerts, appointment confirmations, missed-call text-backs, and invoice/estimate links). Consent is not a condition of purchase. Reply STOP to opt out at any time; reply HELP for support. Message and data rates may apply.
